Proxy Information

An appointed voting proxy is an eligible elector who is acting on behalf of another eligible elector who has been appointed by the elector using the prescribed form to represent them at the voting place. The appointed voting proxy is allowed to cast a ballot on behalf of elector who is not able to attend voting place.

A person shall not (a) appoint more than one voting proxy or (b) act as a voting proxy for more than one unrelated person. The restriction in clause (b) does not apply if the proxy and other person are spouses, or siblings of each other, parent and child, or grandparent and grandchild. Therefore, an eligible elector may either act as a voting proxy for one non-related elector or several related individuals as identified above.

Pursuant to Section 44 of the Municipal Elections Act, 1996, a person shall not appoint a voting proxy for the election until the time for withdrawal of nomination has expired for all offices for which the election is conducted and the appointment must be on the prescribed form.

The first possible date for Applications for Proxy Voting are available from the Clerk's Office is September 13, 2010 unless additional nominations are required in which case the first day is September 15, 2010.

The last day for making application to the Clerk of the Town of Bradford West Gwillimbury for a Certificate to Vote by Proxy is Monday, October 25, 2010 at 4:30 p.m.

The person who has been appointed a voting proxy shall complete the application in the prescribed form, including a statutory declaration that they are the individual appointed as voting proxy. Proxies will certified during regular business hours in the Clerk's Office, Monday to Friday, 8:30 a.m. to 4:30 p.m. from as early as September 10, 2010, after 2:00 p.m., unless additional nominations are required, to and including up to 4:30 p.m., October 25, 2009. Proxies will also be certified in the Clerk's Office, 100 Dissette Street, Units 7 & 8, Bradford, on Saturday, October 16, 2010 and Wednesday, October 20, 2010 from noon until 5:00 p.m.

Q/Procedure for Completing an Application to Appoint a Voting Proxy (Step by Step)

INSTRUCTIONS:

 

Who may use this form:

 

Any qualified elector may use this form to appoint another person who is a qualified elector in the same municipality to vote on his/her behalf. The appointment of the voting proxy can only be made after the final opportunity for withdrawal of nominations.

 

Under Section 44 of the Municipal Elections Act, 1996, an elector may act on behalf of one other qualified elector who is not a relative or on behalf of one or more qualified electors who are relatives. In case where an elector is acting on behalf or more than one qualified electors who are relatives, separate proxy forms are required. A relative means the parent, grandparent, child, grandchild, brother, sister, spouse, sibling of the elector appointed.  Even if an elector eligible to vote in more than one municipality he/she can only

vote as a proxy for one non-relative.  This form is a public record and the copy on file with the clerk may be inspected by any person.

 

FORM 3 SHOULD BE COMPLETED IN THE FOLLOWING MANNER:

 

STEP 1: Complete Boxes A, B and C

 

Boxes A, B and C require the elector making the appointment to identify himself/her and their individual being appointed to vote on the elector’s behalf and to attest to their relationship.

The name of the elector appointed must be filled in at the time the elector making the appointment signs the statement. It is unlawful to sign this proxy form unless Box B is complete.

 

STEP 2: Present duplicate copies to the clerk or designate

The elector appointed must present all copies of this form in person to the Clerk at the Clerk’s Office during normal office hours, or during the hours of 12 noon to 5 p.m. on any day of an advance vote (October 16 or October 20, 2010). The Clerk requires proof of identity of the elector appointed, (including citizenship), before certifying the proxy.

 

STEP 3: Take original form to voting place.

After certification, the Clerk will return the original copy of the form to the elector appointed to be taken to the voting place to receive the proxy ballot.

 

STEP 4: Oral Oath

Once at the voting place the elector appointed will be required to take an oral oath attesting that they are in fact the appointed elector. Once completed, the appointed elector will vote on behalf of the elector whom you were

appointed by.
